These Terms and Conditions of Sale (T&Cs) govern sales made on the website www.atelyaco.fr.

Sales are reserved for adult consumers with full legal capacity.

ARTICLE 2 – PURPOSE
These T&Cs define the rights and obligations of the parties in the context of the online sale of physical products offered by Atelya&Co.
Any order implies full and unconditional acceptance of these T&Cs.

ARTICLE 3 – PRODUCTS
The products offered are described as accurately as possible.
Photographs are non-contractual and may show slight variations depending on screens or production batches.

ARTICLE 4 – ORDER
An order is validated after:

• product selection

• cart validation

• acceptance of the T&Cs

• full payment

Atelya&Co reserves the right to cancel any order in case of fraud or previous dispute.

ARTICLE 5 – AVAILABILITY
Offers are valid while stocks last.
In the event of unavailability after an order is placed:

• full refund within 14 days.

ARTICLE 6 – PRICES
Prices are expressed in euros excluding VAT.
VAT not applicable – Article 293B of the French General Tax Code.

Shipping costs are indicated before order confirmation.

Atelya&Co reserves the right to modify its prices at any time.

ARTICLE 7 – PAYMENT
Secure payment via:

• Stripe (credit card, Apple Pay, Google Pay)

• PayPal

Payments are secured via SSL protocol.

Payment is due immediately.

ARTICLE 8 – PREPARATION AND SHIPPING
Orders are prepared within 1 to 3 business days (excluding weekends and public holidays).

Possible carriers:

• La Poste (Lettre Service Plus)

• Colissimo

• Colis Privé

• Mondial Relay

• Chronopost

Delivery times are indicative and may vary depending on the carrier:
France: 2 to 5 business days
Europe: 5 to 10 days
Outside the EU: 7 to 20 days excluding customs processing

ARTICLE 9 – DELIVERY
Delivery is made to the address provided by the customer.

The seller remains responsible until the product is effectively delivered.

In case of delivery issues:

• carrier investigation will be opened

• customer cooperation is required

Reshipping costs due to an incorrect address are borne by the customer.

ARTICLE 9 BIS – DELIVERIES OUTSIDE THE EUROPEAN UNION AND TO FRENCH OVERSEAS TERRITORIES

⚠️ Orders shipped outside the European Union (Switzerland, United Kingdom, Andorra, Norway, Iceland, International) as well as to French Overseas Departments and Territories (DOM-TOM) may be subject to customs duties, import taxes, local VAT, or administrative fees imposed by the authorities of the destination country. When shipping, a customs declaration (CN22 or CN23) is completed in accordance with applicable regulations.

These charges are not included in the product price nor in the shipping fees charged at the time of order.

They remain entirely the responsibility of the customer, who is considered the importer of the goods.

The amount of such taxes depends on the regulations in force in the destination country and cannot be determined in advance. We recommend checking your country’s customs regulations before placing an order.

In case of refusal to pay taxes or refusal of the parcel, return costs and any administrative fees will remain the responsibility of the customer.

ARTICLE 10 – RIGHT OF WITHDRAWAL
The customer has 14 days after receipt to exercise the right of withdrawal (withdrawal form attached to the T&Cs).

The refund includes:

• product price

• initial standard delivery costs

Return shipping costs remain the responsibility of the customer.

Refund within 14 days after receipt of the returned goods or proof of shipment.

ARTICLE 11 – RETURNS
Products must be:

• unused

• complete

• in perfect condition

• in their original packaging

A depreciation may be applied in case of damage.

Opened or unsealed products may be refused for usage or hygiene reasons.

ARTICLE 12 – LEGAL WARRANTIES
In accordance with French law:
Legal guarantee of conformity: 2 years
Warranty against hidden defects: Articles 1641 et seq. of the French Civil Code.

Pursuant to Articles L217-3 to L217-20 of the French Consumer Code, the consumer benefits from the legal guarantee of conformity for goods presenting a lack of conformity existing at the time of delivery.

The consumer has two years from delivery to take action.

The consumer may choose between repair or replacement of the product, subject to the cost conditions provided by law.

The consumer is not required to prove the existence of the defect during the 24 months following delivery.

ARTICLE 13 – LIABILITY
The seller shall not be liable for:

• improper use of the product

• inappropriate storage

• force majeure events.

ARTICLE 14 – PERSONAL DATA
Data is collected for:

• order management

• customer service

• legal obligations

ARTICLE 15 – INTELLECTUAL PROPERTY
All website content is protected by French and international intellectual property law.
Any reproduction without authorization is prohibited.
